Product Use Restriction & Liability Disclaimer
This provision forms an integral, essential, and binding part of the Company’s Terms of Sale and applies to every purchase, installation, possession, or use of the product, regardless of the country of delivery or use.
Intended Use
The product is a specialized vehicle component and is made available strictly and exclusively for use on private land or private property where the user has previously obtained explicit, lawful, and demonstrable permission from the property owner or legally authorized administrator.
Use is permitted exclusively in environments not subject to public traffic regulations, including but not limited to racing facilities, exhibition venues, static displays, and photography or filming locations, provided that such activities occur entirely outside the public road network and with lawful authorization where required.
Prohibited Use
Use of the product on public roads or in any area subject to public traffic regulation is expressly, absolutely, and without exception prohibited.
The product is not intended, marketed, homologated, or permitted for use on public road networks.
Buyer Acknowledgment
By purchasing the product, the buyer expressly declares and confirms that they have been fully informed of the above restrictions prior to purchase, understand and accept that any non-compliant use is solely their personal responsibility, and bear exclusive responsibility for compliance with all applicable laws, including securing lawful authorization for any use on private property.
The buyer further assumes full responsibility for ensuring that their vehicle remains compliant with all applicable laws and regulations after installation or use of the product.
Limitation of Liability
The Company shall bear no liability whatsoever for any damage or loss, sanction or fine, administrative or criminal consequence, vehicle seizure or immobilization, or any other legal consequence arising from use of the product in violation of these Terms or applicable law.
Any act or omission of the buyer relating to the installation, use, modification, or operation of the product is undertaken solely at the buyer’s own risk and responsibility.
To the fullest extent permitted by applicable law, all liability of the Company arising from acts or omissions of the buyer is excluded. Where liability cannot legally be excluded, and only to the extent such liability is mandatorily recognized by law, the Company’s total and maximum liability shall be strictly limited to the amount paid for the purchase of the specific product.
Nothing in this provision shall affect any rights that cannot be excluded under applicable law.
Indemnification
The buyer agrees to fully indemnify, defend, and hold harmless the Company from and against any claim, demand, administrative action, or legal proceeding by any third party arising from use on public roads, use without lawful authorization of private property, improper installation, or any modification, disassembly, or alteration of the product. This indemnification obligation includes the coverage of legal costs and reasonable attorneys’ fees.
Warranty Void
Any unauthorized intervention, modification, or alteration of the product automatically voids any form of warranty and fully releases the Company from any related liability.
Intellectual Property & Anti-Copying Notice
All designs, technical specifications, 3D files, engineering drawings, descriptions, images, models, components, and any related material concerning the VITPLATE device or any other Company product constitute the exclusive intellectual and industrial property of the Company and are protected under applicable Greek, European, and international intellectual property and unfair competition laws (indicatively Laws 2121/1993 and 146/1914, as in force from time to time), as well as by registered industrial property rights with the Hellenic Industrial Property Organisation (OBI), where applicable.
Any form of copying, reproduction, modification, imitation, processing, disassembly, reverse engineering, or manufacture of identical or substantially similar products without the Company’s prior express written authorization is strictly prohibited.
The above prohibition expressly includes, indicatively and without limitation, production via 3D printing, CNC machining, mold manufacturing, or any other method intended to reproduce, commercially exploit, or technically replicate the product or its underlying designs.
The Company actively monitors and enforces the protection of its intellectual and industrial property rights at national and international level. Any violation of the above entitles the Company to pursue any available legal remedy, including, without limitation, claims for compensation for direct and consequential damages, monetary satisfaction for moral harm, injunctive relief, and the imposition of any civil or criminal sanctions provided by applicable law.
Mandatory Acceptance of Terms
Acceptance of these terms constitutes a mandatory condition for the completion of any purchase. An order cannot be completed unless the buyer expressly confirms, via the designated checkbox on the website, that they have read, understood, and fully accepted these terms.
By completing the order, the buyer expressly declares that they have read, understood, and fully, expressly, and unconditionally accepted the above restrictions.
